Presumably it is the responsibility of the content provider to obtain permission from the donor or partial owner if conditions were imposed at the time of gift. Are artist/copyright holder permissions obtained by member museums or AMICO? MESL made this the responsibility of the museum, which meant that most of us didn't contribute copyrighted material. While on the one hand I would advocate obtaining permissions for the collective, we need to recognize that museums may have special relationships with living artists or their estates, and our legal counsels will want to be well informed of the process.
