Thanks so much for pursuing this; the ability to contribute ARS works would certainly clear the path toward a more signficant modern and contemproary art representation. Based on previous experiences, one concern with ARS centers on the issue of public domain and the differences between the European (personality based) formation of copyright vs the U.S./English (work based) version. For domestic distribution of a reproduction of a work by an American artist, they seem inclined to use a more continental approach thereby extending copyright duration beyond that which is supported by U.S. law. I think I do understand, and in some ways agree with, their position. (Do American Museums really want to offer American artists less than that which is offered to their European counterparts?) However, their unwillingness to engage in any real discussion about such matters (my last conversation with them involved Ted yelling in my ear for about fifteen minutes) makes me question the extent to which they understand and are sensitive to museum issues. Of course, museums, too, can be a little stubborn about these things. I know that the aforementioned public domain issue doesn't specifically affect AMICO which requires international distribution. However, I would be concerned if ARS wanted to use this as an opportunity to push forward trying to obtain broad, individual contracts with each participating museum. That said, you and David have a really solid and sane take on all sides of these issues and am 100% confident that you will represent our interests as you talk with artists rights societies.
