Alan has asked a number of good questions.

AMICO Library Museum Agreement

7.1 Permitted Uses (6) do we really mean to prohibit all free distribution to the general public such as use in exhibition gallery guides. Doesn't free distribution to the general public belong with the permitted uses rather than the prohibitions?

We think, unfortunately, that the answer is no. AMICO members prohibited any publication, even if free, without further license. Is this something members want to reconsider?

8.3 Retention of adaptations If we create an exhibition orientation video that is not sold there is no language allowing us to keep this after termination of the agreement.

Yes, you may keep it under the terms of the permissions, #8. Possibly this will be something to clarify in the future.

10.2 Museum Policies and Procedures Can JT/DB provide us with a standard document to distribute to our users to help us "effectively disseminate policies and procedures governing proper use"? The contract is not a good lay document for all the users.

That's for sure. Yes. We'll find some simple language (a paragraph probably).

13.1 AMICO notices

If the AMICO representative is travelling an off-line, and submits an auto message that they will return on such a date we would like the return date to be the date of the Notice.

We'll try to notify institutions with several addressees if they are provided. The same problem, of course, occurs with snail mail.

AMICO Membership Agreement

5.2 Grant of Rights Please clarify "reproduce" & make "derivative works". We assume we are not granting rights to AMICO for print publication.

If you read on, you'll see: "solely as part of or in connection with the compilation and distribution of the AMICO Library."

8. Dissolution of AMICO We would like to append a phrase to this paragraph "under the same contractual obligations as this agreement".

This is said in an earlier clause.

9.1 Notices (same comments as 13.1 above)

same response. Give us several people or an address that will receive and open the mail for the institution.

Thanks, D&J
